Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Secure Vault application (the "App") or website (the "Service"), or by creating an account, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and OneSecureVault ("we", "us", "our").

2. Description of Service

Secure Vault is an encrypted cloud storage service that allows registered users to securely upload, organise, and retrieve photos, videos, and notes (collectively, "Content"). The Service is provided by OneSecureVault and is available on Android and iOS mobile platforms.

The Service is intended for personal, non-commercial use unless otherwise agreed in writing.

3. Eligibility & Account Registration

To use the Service you must:

  • Be at least 16 years old, in compliance with the GDPR Article 8 age of digital consent in the European Union. If you reside in a jurisdiction with a higher minimum age, that higher age applies.
  • Provide accurate, current, and complete information when creating your account
  • Maintain the security and confidentiality of your password and authentication credentials
  • Notify us immediately at security@onesecurevault.com if you suspect unauthorised access to your account

You are solely responsible for all activity that occurs under your account. We reserve the right to refuse registration or suspend accounts at our discretion.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a manner consistent with all applicable local, national, and European Union laws and regulations, including but not limited to:

  • The Digital Services Act (EU) 2022/2065
  • The General Data Protection Regulation (EU) 2016/679
  • EU law on illegal content and online platforms

You expressly agree not to use the Service to store, upload, share, or otherwise process:

  • Child Sexual Abuse Material (CSAM) or any content that sexually exploits minors — zero tolerance, immediately reported to authorities
  • Content that is illegal under the laws of the European Union or your country of residence
  • Malware, viruses, ransomware, spyware, or any other malicious code
  • Content that infringes on the intellectual property rights of any third party
  • Content constituting harassment, hate speech, or incitement to violence
  • Content that violates the privacy or dignity of others, including non-consensual intimate imagery
  • Material used for phishing, fraud, or other deceptive practices

You also agree not to:

  • Attempt to gain unauthorised access to any part of the Service, other user accounts, or our infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the App or Service
  • Circumvent or attempt to bypass any rate limiting, security, or authentication mechanism
  • Use automated scripts or bots to access the Service without prior written authorisation
  • Resell, sublicense, or commercially exploit any part of the Service without written permission

Violation of this policy may result in immediate account suspension or permanent termination without notice, and may be reported to law enforcement authorities where legally required.

5. Content Ownership & Licence

You retain full ownership of all Content you upload to the Service. Uploading Content to Secure Vault does not transfer ownership or any intellectual property rights to us.

You grant OneSecureVault a limited, non-exclusive, royalty-free licence solely to store, process, and transmit your Content for the purpose of providing the Service to you. This licence is revocable by deleting your account.

We do not read, scan, analyze, train AI models on, or otherwise use the content of your files for any purpose beyond delivering the storage service.

6. Storage Limits & File Restrictions

  • Free accounts include 10 GB of storage
  • Maximum file size: 50 MB per image
  • Maximum file size: 5 GB per video
  • Accepted file types: photos and videos only (JPEG, PNG, HEIC, MP4, MOV, and other standard media formats)

We reserve the right to modify storage limits with reasonable advance notice to users. Changes will be communicated via in-app notification and/or email.

7. Service Availability

We strive to maintain a high level of service availability. However, we do not guarantee uninterrupted, error-free access to the Service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (communicated in advance where possible)
  • Emergency maintenance or security incidents
  • Infrastructure failures beyond our control
  • Force majeure events

We recommend maintaining local backups of important files and not relying solely on the Service for data storage.

8. Account Suspension & Termination

By you: You may delete your account at any time from Settings → Account → Delete Account within the app, or by contacting us at legal@onesecurevault.com. Upon deletion, all your data will be permanently removed within 30 days.

By us: We reserve the right to suspend or terminate your account without prior notice if we determine, in our sole discretion, that you have:

  • Violated these Terms, particularly the Acceptable Use Policy
  • Used the Service in a way that poses a security or legal risk
  • Provided false information during registration
  • Engaged in any fraudulent, abusive, or harmful activity

Where suspension is made in error, you may contact us to appeal the decision at legal@onesecurevault.com.

9. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, OneSecureVault shall not be liable for:

  • Loss of data resulting from user error (e.g., accidental deletion)
  • Unauthorised access to your account due to compromised credentials on your side
  • Indirect, incidental, consequential, or punitive damages arising from use of or inability to use the Service
  • Data loss resulting from force majeure events
  • Third-party actions outside our reasonable control

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable EU consumer law.

10. Distribution Platform Terms

The App is distributed through the Google Play Store and may be distributed through the Apple App Store. By downloading the App from these platforms, you also agree to the respective platform's terms of service:

  • Google Play Terms of Service
  • Apple Standard EULA

OneSecureVault, and not Google or Apple, is solely responsible for the App and its content. Google and Apple are not party to these Terms and have no obligation to provide maintenance, support, or warranty services for the App.

11. Intellectual Property

All elements of the Service not constituting user-uploaded Content — including the application code, interface, design, logos, trademarks, and text — are the exclusive property of OneSecureVault and are protected by European and international intellectual property law.

You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

12. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

13. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we do:

  • The "Last updated" date at the top of this page will be updated
  • You will be notified via an in-app message for material changes
  • For significant changes affecting your rights, we will request your renewed acceptance before continued use of the Service

Continued use of the Service after changes are in effect constitutes your acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with applicable European Union law and the law of the country in which OneSecureVault is established, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in our place of establishment.

If you are a consumer in the European Union, you may also benefit from mandatory consumer protection provisions in your country of residence, which these Terms do not limit. You may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr

15. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and Legal Notices, constitute the entire agreement between you and OneSecureVault with respect to the Service.
